The Procedural History

The plaintiff, Ronald Kendall, an employee of Reynolds Metal Company, was injured when a crane he was operating snapped free from the ceiling of Reynolds’ factory and struck him. He sued Cleveland Crane & Engineering Company, manufacturer of the crane, Bohnert Equipment Company, the seller of the crane to Reynolds, and Rapid Installation Company which installed the crane. Kendall sought recovery on the strict liability theory of Section 402A of the Restatement of Torts 2d against Cleveland and Bohnert and on a negligence theory against Rapid Installation.…
