We have this case before us on certificate- from' the General Counsel, Department of the Treasury, for the United States Coast Guard, in accordance with the provisions of the Uniform Code of Military Justice, Article 67 (b) (2), 50 USCA § 654. The accused, Meyer, QM3, United States Coast Guard, was tried by general court-martial held in Cleveland, Ohio, on May 16, 1951, for the offense of desertion in violation of legislation relating to the Coast Guard, 14 USCA § 143.
