Plaintiff, Hector Gonzales Valdez, appeals from a summary judgment in favor of defendants, Paul Howard Smith and West Transportation, Inc. The issue presented is whether plaintiff’s action is barred by the one-action rule under Code of Civil Procedure section 377.
