This matter is before the Court upon two motions to dismiss filed by the United States of America (“Defendant”): (1) Defendant’s motion to dismiss Plaintiffs survival action claim pursuant to Fed.R.Civ.P. 12(b)(1), and (2) Defendant’s motion to dismiss the loss of consortium cause of action and to dismiss Gracie White as an individual plaintiff pursuant to Fed.R.Civ.P. 12(b)(1) & (6).
