This is a personal injury action brought under the Federal Tort Claims Act, 28 U.S.C. §§ 1346, 2671 et seq. (“FTCA”). Before the court are three motions: the United States’ motion to dismiss or in the alternative for summary judgment pursuant to Federal Rules of Civil Procedure 12(b)(1), 12(b)(6), and 56 (Doc. 6); Plaintiff Billy Lee Boles, Jr.’s motion to file an amended complaint pursuant to Rule 15 (Doc. 11); and the United States’ motion to strike Boles’ demand for a jury trial.
