Defendant was convicted before a jury of the crime of rape, by force and violence, and he now appeals from the judgment of conviction and from an order denying a motion for a new trial.

The defendant is forty-four years of age and resides in the city of Tracy, California; he works in the southern part of the state; his wife and he have their home in Tracy. The victim, Janice Amos, is a married woman, thirty years of age, has a nine-year-old child; and also lives with her husband in Tracy.
