The plaintiff recovered a judgment in an action for damages for personal injuries based on negligence. The defendant, appealing, has brought to this court only the pleadings and judgment, and asserts as sole ground for reversal that the complaint, hitherto unchallenged by motion, demurrer or otherwise, does not state facts sufficient to constitute a cause of action.
