Plaintiff, Charles Koehler, a minor, appellee, had jndgment in the Snperior Conrt in an action on the case for personal injnries snstained in rnnning behind one car and being struck by another car of the defendant company, appellant7 passing in the opposite direction on adjacent tracks. The accident happened August 30, 1904, at a place where Forty-eighth street, if it ran through, would intersect Wentworth avenue, in the city of Chicago.

The plaintiff, who was then a hoy of ten years old, in company with another hoy about eight years old, named John Connors, after having been to a shoemaker…
