The trial court sustained the plaintiffs in error Lorch, in their claim that the notice to quit served upon them was not a legal notice, in that it was not a “duplicate copy” but was merely a true and attested copy of the' original notice. No other proof of service of the notice to quit was made than the officer’s return. In the statute as first enacted (Public Acts of 1806, p. 729) it was provided that a duplicate copy of the notice should be delivered to the lessee, or left at his place of residence, “in the presence of at least one credible witness.” In the Revision of 1875, p. 491, the…
