This is a suit by Plaintiff, J. Corbett, a former employee "of Defendant, Schlumberger Well Surveying Corporation, to recover for alleged unpaid overtime during the period from “about” November 1, 1938, to January 15, 1941, and penalty and attorney’s fee under the Fair Labor Standards Act of 1938, 29 U.S.C.A. §§ 201 to 219. Defendant’s defense is that Plaintiff and Defendant and their contractual relations do not come within the scope of the Act and particularly Sections 3 and 7 thereof, that Defendant is a service establishment within the meaning of Section 13 of the…
