This case is here on appeal from a decree rendered by the chancery court of Davidson county. Appellants here were, respectively, complainant and cross complainant below. The bill was filed March 12,1909.

There is no material controversy about the facts. There are two assignments of error, by each of which appellants insist that the court below did not correctly apply the law to the facts. It appears that Len K. Hart died intestate in Davidson county, on February 14,1909, leaving surviving him his widow, Mrs. Lucy E. Hart, and two minor children.
