WELCH, Justice.
From the judgment entered on a jury verdict in favor of the plaintiff, the defendant seeks reversal and remand of this cause for a new trial. Reference will be made to the parties to correspond with their respective positions in the trial court. Our study of the briefs submitted on behalf of the parties, and our examination of the record leads to the conclusion that the judgment of the trial court was free of material error and should be affirmed.
