And Now, this 16th day of December, 1997, following oral argument with counsel for the parties, and upon consideration of the motion to dismiss by the defendants, and plaintiff’s response thereto, it is hereby ORDERED that the motion is DENIED as to Judge Herron as to Counts 1 & 2. It is FURTHER ORDERED that the motion is GRANTED as to Judge Bonavitacola as to Counts 1 & 2. It is FURTHER ORDERED that the motion is GRANTED for both defendants as to Count 3.
