Smith, J.:

This is an action to set aside a tax deed to real estate, and to quiet title to rights and interests claimed in the real estate. *195The trial court overruled defendants’ demurrer to plaintiffs’ petition. Defendants have appealed.

The action has been in this court before. At that time we reversed the order of the trial court overruling defendants’ demurrer and ordered judgment for defendants. On consideration of plaintiffs’ petition for a rehearing we modified our opinion by making it provide merely that the demurrer be sustained. We did not order…
