This is an appeal of a sanctions order issued by the Bankruptcy Court. The Court has jurisdiction over the appeal pursuant to 28 U.S.C. § 158(a)(1).
On March 30, 2007, Appellee, Debtor Irene Michelle Schwartz-Tallard, filed for Chapter 13 bankruptcy in this District. On February 27, 2009, Appellant, America’s Servicing Co., moved for relief from automatic stay with respect to Appellee’s real property located at 17 Caprington Road, Henderson, NV (the “Property”).
