JOHN GARRETT PENN, District Judge.

Plaintiff filed this action pursuant to 42 U.S.C. § 405(g) to appeal the decision of an Administrative Law Judge (ALJ) of the Social Security Administration which denied her application for widow’s insurance benefits. She had applied for the benefits under 42 U.S.C. § 402(e) as the common-law wife of Ernest B. Jackson.1 The case is now before the Court on plaintiff’s motion for summary judgment, and on defendant’s motion for summary affirmance.
