RAYMOND J. BRODERICK, District Judge.

Presently before the Court in this civil rights action for denial of workmen’s compensation benefits is Defendants’ motion for summary judgment. Defendants argue that the Plaintiffs claims are barred by the Eleventh Amendment, by the exclusivity provisions of the state workmen’s compensation act, and by the Plaintiffs inability to prevail as a matter of law under 42 U.S.C. § 1983 (1993).
