WILKEY, Circuit Judge:
This case involves an appeal from dismissal of the case by the District Court, for failure by plaintiff to respond to the FBI’s discovery request. Appellants argue that dismissal was improper both as a matter of law and under the particular facts of this case. They also argue that the trial court erred in not granting them a protective order and in awarding expenses to the FBI. Appellant Lesar, counsel below for appellant Weisberg, also argues separately that it was error to include him in the award of expenses. We find…
