At the regular school election on May 5,1930, in school district No. 28, in the county of Conejos, Frank Winters, plaintiff in error, hereinafter referred to as contestee, and Faustin Pacheco, one of the defendants in error, hereinafter referred to as contestor, were two' announced candidates for the office of treasurer of the district. According- to the return of the judges of election, contestee received 66 votes, was declared elected, and immediately thereafter qualified, while- the contestor received 65 votes.
