The foundation facts of this litigation, as disclosed by the record, are so clearly stated in brief of appellant’s counsel (it being the defendant below), that we; take this excerpt therefrom: “Connecting with appellant’s Elkhorn & Beaver -Valley Branch at Garrett, in. Floyd County, is a spur track extending up Stone Coal Creek, and known as the Stone Coal Spur.
