OPINION

HORN, Judge.

FINDINGS OF FACT

The plaintiff, Gregory Chandler, filed a complaint in the United States District Court for the Northern District of California on July 7, 1997. After the California District Court ordered the case transferred to this court for lack of jurisdiction, plaintiff filed his complaint in this court.1 Plaintiff alleges breach of contract, negligence, and due process violations, all stemming from his assertion that he has never been released from active military duty, and that he is an active duty major in the Army,2 who is entitled to promotion to the rank of…
