Wheatley brought an action for the specific performance of an alleged contract for the purchase of land. The *202petition alleged the making of the contract, a' tender of the purchase-money, and the refusal of the defendant to accept the same and make the plaintiff a deed. The defendant demurred to the' petition, on the grounds, that no cause of action is set forth; the contract is unilateral; the petition fails to allege that the contract was in writing; and there is no allegation that the plaintiff prepared and tendered a deed to the defendant.
