This case comes irregularly before this court. It is brought up on a motion in error ; and it does not appear that any of the questions set forth in the assignment of errors claimed to have been committed by the court below, were ever brought to the attention of the court, or passed upon during the tidal. For aught that appears they are questions now made for the first time, and if so our rules deny to the party making them the right to be heard upon them.
