This cause has been three times argued. We understand from the case, as well as from the statement of the defendants’ counsel at the first argument, that so far as the liability of the town might depend on the length of time that the bales of hay had been suffered to lie upon the highway, or upon proper notice to the town officers that they were there, the ruling of the county court were such that the defendants took no exception.
