GREENE, Judge.
The State of North Carolina appeals an order dated 14 January 2000 in favor of Lisa Strum Allen (Defendant).
The record shows Defendant was indicted on 26 October 1998 for felony child abuse, pursuant to N.C. Gen. Stat. § 14-318.4(a). Defendant was tried before a jury at the 1 November 1999 criminal session of the Superior Court of Johnston County.
