JENKINS, J.

On March 29, 1914,' the plaintiff in error issued to the defendant in error a policy on a house in Mart, McLen-nan county, Tex., described in the policy as being used for the storage of ic-e and beer. Tnereafter, before the expiration of the time for which the building was insured, it was totally destroyed by fire. The building had teen so used prior to July, 1914, at which time local option ,was adopted in the precinct in which Mart is located, and at and for two years prior to the time of the fire it was used toy the Mart Ice Company for the storage of salt and…
