An indictment was returned and filed against defendant charging him with the crime of burglary pursuant to Minn. St. 609.58, subd. 2(1), as follows:

“* * * Norman Drews, on the 3rd day of February, 1965, at the Village of Bena, in the county of Cass and State of Minnesota, did wilfully, wrongfully, unlawfully, intentionally, and feloniously in the night time, enter a certain building, to wit: The Bena Liquor Store * * * without the consent of [the owner of the building], with intent then and there entertained by said defendant to commit a crime in said building, to wit: the…
