Defendant was convicted of the crime of bribery and appealed from an order denying Ms motion for a new trial.

Defendant and Fred A. Maurer were Minneapolis aldermen representing the third ward therein. On their motion the city council on March 11, 1927, authorized the purchase of a G. M. C. five-ton truck from the General Motors Truck Company for $8,501.25. The indictment is that defendant received from Maurer $405 in consideration of his voting for the purchase of the truck.
