I. INTRODUCTION

Plaintiff commenced this action asserting discrimination and civil rights claims pursuant to 42 U.S.C. §§ 1981 & 1983, and supplemental state tort and constitutional violation claims, for conduct occurring in the Guilderland Central School District. See generally Compl. [doc. # 1], Defendants have moved pursuant to Fed. R. Civ. P. 12(c), or in the alternative, pursuant to Fed. R. Civ. P, 56, to dismiss certain claims against certain defendants.
