On July 17, 1986, defendant-appellee, Sparta Energy Corporation, was charged alternatively on two counts of negligent violation of R.C. 1509.22. Under the first count, appellee was charged with the negligent placement of brine in surface water or groundwater in or on the land in such quantities or in such manner as to actually cause or reasonably be anticipated to cause damage or injury to public health or safety of the environment R.C. 1509.22(A).
