MEMORANDUM OPINION AND ORDER

Defendants Capital City Mortgage Corporation (“Capital City”) and Thomas K. Nash (“Nash”) have moved for judgment on the pleadings, or, in the alternative, for summary judgment, on ten of the eleven counts brought in the first amended complaint. In response, plaintiffs have filed an opposition, and pursuant to this Court’s March 14, 2000 Order, the United States has filed a brief as amicus curiae, addressing defendants’ motion.
