APPEAL from tbe Circuit Court for Dodge County Action for injuries to tbe plaintiff’s person alleged to have been caused by defendant’s negligence. The verdict was special, in answer to nine interrogatories, and found the following facts: That plaintiff’s and defendant’s wagons collided at the village of Hustisford; that [in consequence of such collision] plaintiff’s horse fan away, and plaintiff was injured in his person; that defendant did not exercise ordinary care in passing plantiff’s wagon, but was driving with a loose line and in a careless manner, and not keeping a sufficient distance…

The material issues upon which the liability of the defendant depended, appear to have been fully and clearly submitted to the jury, and specifically found by them, and, as we think, upon sufficient evidence; and this court would not be warranted in disturbing the findings, unless it is apparent that the jury was misled, to the prejudice of the defendant, in some of the respects claimed by the learned counsel of the appellant, by improper instructions given or proper instructions refused.
