Harvey, J.:

This is an appeal by defendant from a judgment in favor of plaintiff in an action for personal injury resulting from a collision between a motorcycle driven by plaintiff and an automobile driven by defendant. The. appellant assigns many errors.

There is but little controversy concerning the material facts in the case. What is known as the West Sixth street road is an improved highway extending from the city of Topeka, west to Gage park, about two miles distant. It is graded and paved through the center with an asphalt pavement twenty feet…
