The errors assigned which have been submitted in argument are, first, that the court overruled the defendant’s motion for nonsuit, which was based upon the proposition that the complaint fails to state a cause of action and that there was no evidence offered disclosing any actionable negligence on the part of the defendant proximately causing the accident complained of.
