Defendant in error brought her action in the District Court on a contract of insurance entered into between her husband and plaintiff in error, in which contract plaintiff was named as beneficiary. On March 26th, 1913, plaintiff’s husband, the assured, died from the effects of a dose of arsenic, which he took on that day. Plaintiff contends that the arsenic was taken by mistake, while defendant insists that the evidence shows it was taken with suicidal intent.
