This appeal is prosecuted by the Chicago, Milwaukee and St. Paul Railway Company from a judgment of the county court of DuPage county confirming a special assessment levied against its property by the village of Bensenville for a water system in said village.

The property of appellant assessed is used exclusively for railroad purposes. It is part of appellant’s extensive yards in the village, consisting of 115 miles of track and about 1100 acres of land.
