All of the defendants 1 and the plaintiff Mutual Fire, Marine and Inland Insurance Company (“Mutual Fire”) have moved to dismiss the intervenor complaint of Bar-clays Business Credit, Inc. (“Barclays”). The motions raise three issues: (1) whether Barclays’ intervention destroys this Court’s diversity jurisdiction, (2) whether the doctrine of res judicata precludes Barclays from intervening in this case, and (3) whether Barclays’ cross-claims against Mutual Fire are prohibited by a Rehabilitation Order issued by the Pennsylvania…
