CHR General, Inc. (CHR), brought an action for declaratory and injunctive relief against the city of Newton, to determine the validity of a city ordinance intended to regulate the conversion of residential rental units to condominiums, 1 and to enjoin the city from enforcing the ordi nance while the action was pending. A judge of the Superior Court denied the plaintiff’s request for a preliminary injunction but subsequently judgment was entered for the plaintiff, declaring the challenged ordinance invalid.
