DOUMAR, District Judge.

This matter is before the Court sitting as a court of appeals pursuant to 28 U.S.C. section 636(c)(4) on an appeal by the plaintiff/husband from a final judgment of the United States Magistrate granting summary judgment in favor of the defendant/wife. The plaintiffs action seeks damages resulting from the defendant’s alleged breach of an oral separation agreement.
