Appeal by the defendant, Isadore Atlas, from a judgment of the Court of Special Sessions of the City of New York, First Division, rendered against him on or about the 2d day of March, 1917, convicting him of violating section 435 of the Penal Law in that he unlawfully and with intent to defraud exposed for sale to the public generally certain meats which he falsely represented to be kosher meat and as having been prepared under orthodox Hebrew religious requirements.

The defendant was tried on an information filed by the district attorney charging him with having violated the provisions of section 435, subdivision 4, of the Penal Law, which, so far as material to the facts charged in the information, provides that a person who, with intent to defraud, “ sells or exposes for sale any meat or meat preparation and falsely represents the same to be kosher, or as having been prepared under and of a product or products sanctioned by the orthodox Hebrew religious requirements; or falsely represents any food product or the contents of any package or…
