This diversity declaratory judgment action is a dispute over whether the plaintiff-insurer has a duty to defend the defendant-insured in an ongoing state-court lawsuit. Specifically, at issue on cross-motions for summary judgment is whether the defendant-insured’s commercial general liability insurance policy may provide coverage with respect to any of the claims in the Virginia state-court action against the insured.
