This case reached this court by way of transfer pursuant to Article V, § 10, Constitution of Missouri, and Civil Rule 84.05(a) (now Rule 83.03), V.A.M.R.

This action for a declaratory judgment1 was instituted by State Farm Mutual Automobile Insurance Company (State Farm) in the Circuit Court of Butler County against Sue Smart (Smart), Harold Lee Hisaw, Sr. (Hisaw), and MFA Mutual Insurance Company (MFA) to ascertain the liability of the two insurers in a damage suit brought by Smart against Hisaw following an accident which occurred in Poplar Bluff on November 20, 1964.
