delivered the opinion of the court:

The defendants Norman Winslow, Jimmie W. Lauderdale and Ira Newton were convicted after a joint bench trial and sentenced for the offenses of attempt burglary (2-8 years in the penitentiary), attempt theft (1 year in the penitentiary) and possession of burglary tools (1-2 years in the penitentiary). The sentences were to run concurrently. Each of the defendants appeal.
