Reversing.
Appellant, Millard Saylor, under an indictment charging him with the murder of Earl Calloway, was convicted of manslaughter and his punishment fixed at confinement in the penitentiary for a period of ten years.
It is urged in his behalf that the judgment should he reversed because (1) the verdict is flagrantly against the evidence; (2) the trial judge abused a sound discretion in refusing to send the jury to view the scene of the killing; and (3) the court erred in refusing to grant a new trial on the ground of newly discovered evidence.
