Reversing.
The grand jury of’ Bourbon county returned an indictment agáinst the appellant, Oscar N. Johnson, charging him with murdering Walter Rice, which occurred at about 7 p-. m. on January 29, 1918, in the restaurant of A’Efern & Burton, located at the corner of Tenth and Pleasant streets in the city of Paris, Kentucky. Appellant entered a plea of not guilty, but upon his trial the jury convicted him and fixed his punishment at death. His motion for a new trial having been overruled, he prosecutes this appeal, relying upon, three grounds for a reversal:…
