It appears from the record in this case that the defendant in error, John M. Graham, was, from the 10th day of January, 1903, up to November 16, 1907, judge of the probate court of Kingfisher county, territory of Oklahoma, and from and after the 16th day of November, 1907, up to the 9th day of January, 1911, county judge of Kingfisher county, state of Oklahoma.
