DOBIE, Circuit Judge.

John Harris (hereinafter called Harris) was tried in the United States District Court for the District of Maryland under an indictment in two counts, charging violation of 18 U.S.C.A. § 338, commonly known as the Mail Fraud Statute. .

The first count charged that Harris had devised a scheme to defraud Mrs. Isabelle M. Cochran, Lieutenant-Commander Schamyl Cochran, Harry Ivery and others, and by means of fraudulent representations, to obtain their money.
