Pending is Defendant’s Motion to Dismiss, ECF No. 12, and Plaintiffs Motion Requesting Hearing on Defendant’s Motion to Dismiss, ECF No. 26. Defendant’s Motion to Dismiss is GRANTED in part and DENIED in part. Plaintiffs breach of contract claim that Defendant required Plaintiff to get flood insurance in excess of what was required under the Deed of *814Trust, force-placed such insurance, and charged the cost to Plaintiff survives this Motion to Dismiss.
