Appellee sued appellant to recover on a certificate of deposit showing that appellee had deposited with appellant the sum of $6,832.36, Mexican money, or its equivalent in money of the United States of America, at the ratio of 73 cents in American money for every dollar in Mexican money. Afterwards the death of M. H. Cross .was suggested to the court, and an amended petition was filed by Meliton Cross, independent executor of 'the last will and testament of said M. H. Cross, deceased, in which was embodied a copy of the certificate of deposit for $6,836.36, and in which a detailed statement…
