GALLAGHER, Chief Justice.

This suit was instituted by appellants, Joe B. Fortson and J. T. Fortson, against appellee, John R. Williams, to recover $300 principal and $30 attorney’s fees on a promissory note executed and delivered to them by appellee, dated September 29, 1936, for the principal sum of $381.25, with interest from date at the rate of eight per cent per annum and providing for the payment of ten per cent additional as attorney’s fees.
